Bottled Water Store Terms of Sale
Effective October 21, 2026
These Terms of Sale govern every sale of products by Bottled Water Store, LLC ("Seller"), to the customer named on the estimate, order, or invoice ("Buyer").
1. Agreement and acceptance
Buyer accepts these Terms by approving an estimate in writing (including by email), placing an order, issuing a purchase order, making any payment, or accepting delivery. These Terms, together with Seller's estimate or invoice, are the entire agreement for the sale. Any different or additional terms in Buyer's purchase order or other documents are rejected and do not apply unless Seller agrees to them in a signed writing.
2. Quotes and pricing
Estimates are valid for 30 days unless stated otherwise. Prices exclude sales tax, freight, and other charges unless shown on the estimate. Seller may correct clerical errors in pricing before shipment.
3. Payment schedule
Custom orders require the deposit stated on the estimate before production begins. The remaining balance is due before the order ships. Seller will not release any order for shipment until it is paid in full. Seller may extend credit terms only by written approval, and may change or withdraw credit terms, place an account on hold, or require prepayment at any time.
4. Card payments and payment disputes
By providing a credit or debit card, Buyer authorizes Seller to charge that card for the deposit, the remaining balance when the order is ready to ship, and any other payments stated on the estimate. If a scheduled charge is declined, Buyer must provide a valid payment method within 3 business days. A declined payment or a chargeback on product that was delivered as ordered does not cancel Buyer's obligation to pay, and the amount remains due under Section 5.
5. Late payment and collection costs
Past-due balances accrue a late charge of 1.5% per month (18% per year) or the maximum rate permitted by law, whichever is lower, from the due date until paid. Buyer agrees to pay all costs Seller incurs to collect any past-due amount, including reasonable attorney fees, collection agency fees, and court costs, to the extent permitted by law. Seller may stop or delay any order, including orders in production, while any balance is past due.
6. Label proofs and artwork
Buyer must approve a final label proof in writing before production. Buyer is responsible for reviewing spelling, dates, artwork, and all other content on the proof. Seller is not responsible for errors in an approved proof. Buyer confirms it has the right to use all names, logos, images, and artwork it provides, and agrees to indemnify Seller against any claim that its artwork infringes the rights of others.
7. Shipping, title, and risk of loss
Orders ship by freight carrier. Ship dates and delivery dates are estimates, not guarantees, and Seller is not liable for delays caused by carriers, weather, or other events outside Seller's control. Buyer must have someone available to receive and unload the shipment. Liftgate, residential, appointment, inside delivery, redelivery, and storage charges are billed to Buyer unless included on the estimate. Unless otherwise stated in writing, title and risk of loss pass to Buyer when the order is delivered to the carrier.
8. Inspection, shortages, and freight damage
Buyer must inspect every shipment at delivery. Visible damage or shortages must be noted on the carrier's delivery receipt before signing, and reported to Seller with photos within 3 business days of delivery. Seller will assist Buyer with carrier claims for damage noted on the delivery receipt. Damage or shortages not noted on the delivery receipt, or not reported within 3 business days, are deemed accepted.
9. Cancellations and returns
Custom-labeled products are made to order. Orders cannot be cancelled once production begins, and custom-labeled products cannot be returned. Changes before production begins require Seller's written approval and may be subject to charges for costs already incurred.
10. Limited warranty
Seller warrants that products will match the description on the estimate or invoice and the approved label proof at the time of delivery. If a product does not, Buyer's sole remedy is replacement of the product or a refund or credit of its purchase price, at Seller's option, provided Buyer notifies Seller within 30 days of delivery. EXCEPT AS STATED IN THIS SECTION AND TO THE EXTENT PERMITTED BY LAW, SELLER MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
11. Limitation of liability
To the extent permitted by law, Seller's total liability for any claim arising from a sale will not exceed the amount Buyer paid for the products involved. Seller is not liable for any indirect, incidental, special, or consequential damages, including lost profits or event costs.
12. Governing law and venue
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law rules. Buyer agrees that any action relating to a sale may be brought in the state courts located in Saint Joseph County, Michigan, and Buyer consents to the personal jurisdiction of those courts. Seller may also bring an action to collect amounts owed in any court where Buyer resides, does business, or has assets.
13. General
Seller may update these Terms at any time. The version posted at bottledwaterstore.com/terms on the date of Buyer's order applies to that order. If any provision is found unenforceable, the rest remain in effect. Seller's failure to enforce a provision is not a waiver of it. Questions about these Terms can be sent to customerservice@bottledwaterstore.com or (888) 604-7067.
